Kingston Man Charged After Allegedly Being Found Passed Out Behind The Wheel Along The 401

KAWARTHA LAKES-Members of the Leeds County OPP say officers located a motor vehicle stopped on the side of Hwy 401 westbound near Lansdowne with the driver found to be unresponsive.

Police say following further interaction, the driver awoke, and it was determined he had consumed alcohol and was subsequently arrested.

47-year-old Douglas Whaley of Kingston, Ontario was charged with:

  • Operation While Impaired – Alcohol and Drugs contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Operation While Impaired – Blood Alcohol Concentration (80 plus) contrary to section 320.14(1)(b) CC
  • Fail to comply with Probation Order x2 contrary to section 733.1(1) CC.

The accused was released from police custody and is scheduled to appear before the Ontario Court of Justice in Brockville on November 18th, 2022.
